1. Who we are

Zealty.ca, the Zealty apps and related services are operated by Zealty Online Search Inc. (“Zealty”, “we”, “us”). MLS® listing data is provided through a Virtual Office Website (VOW) hosted by Holywell Properties, a licensed British Columbia brokerage. Zealty and Holywell Properties handle your personal information as described in this policy, in line with PIPEDA, BC’s Personal Information Protection Act, Alberta’s Personal Information Protection Act and Canada’s Anti-Spam Legislation (CASL). Zealty is intended for residents of Canada outside Quebec.

2. What we collect

• Information you give us: name, email, phone number, account password, showing requests and agent contact requests (including your message, the property, preferred times and whether you have an agent), home details for evaluations, mortgage calculator inputs, saved searches, favourites, rejected or hidden listings, notification settings and display preferences (such as theme and layout).
• Information collected automatically: IP address, device and browser details, pages and listings viewed, property visit history, searches and filters used, clicks, approximate location, ad click identifiers, and session recordings of how you use our pages (form entries are masked).
• Information from others: Google sign in details if you use it, updates from partner agents about your inquiry, and public property data.
• Calls and messages: calls, texts and emails with us or our partner agents through our CRM (Close) are stored, and calls may be recorded, transcribed and summarized by AI for quality, agent coaching and training, record keeping, and following up on your request.

3. How we use it

• To run Zealty, provide search, alerts and sold data, and meet real estate board rules.
• To connect you with a REALTOR®, mortgage professional or lawyer when you ask, and follow up on your request.
• To recommend listings and help your agent understand what you are looking for, including using AI tools (such as our CRM’s features and Anthropic) to summarize your activity and conversations. Our AI providers do not train their models on your data.
• To send service messages, and marketing emails within the period CASL allows (6 months after you sign up or make a request) or with your consent. Saved search alerts are sent because you set them up. Every marketing email has an unsubscribe link.
• To measure and improve Zealty, prevent fraud, and advertise Zealty on other platforms.
• To comply with the law.

We do not use your information to discriminate or to make decisions with legal or similar effects on you.

4. Who we share it with

• Partner REALTORS®: when you ask for help, we share your details, request and relevant site activity with an independent licensed REALTOR® and their brokerage. Zealty and its affiliates, including Holywell Properties, receive 25% of the agent’s commission if you buy or sell with them; it costs you nothing extra.
• Mortgage brokers and lawyers: when you ask, we share your contact details and request with the professional named on the page. Mortgage brokers pay Zealty a flat advertising fee; we receive no referral fees from them.
• Service providers: hosting, CRM, email, analytics and AI providers that work for us, including Google Cloud, Amazon Web Services, Cloudflare, Close, SendGrid, Sentry, Anthropic and our affiliate Offerland Technologies Inc. (which produces OfferValue® and OfferRent® estimates).
• Advertising platforms: we share a hashed (scrambled) version of your email and phone with Google Ads Customer Match and Meta Custom Audiences to show you Zealty ads and measure our ads. Hashed data is still personal information. You can opt out anytime by emailing [email protected], and we will remove you within 30 days.
• Real estate boards and regulators: MLS® boards may access your VOW registration and our records to check compliance with their rules, and regulators may access records as the law requires.
• Others: where required by law, to protect rights and safety, or in a merger, sale or financing of our business.

We may share or sell anonymized or aggregated data that does not identify you.

5. Cookies and tracking

We use cookies and similar technologies in four groups:

• Essential: our own cookies that keep you signed in and remember your settings, Cloudflare and Cloudflare Turnstile for delivery and bot protection, and Sentry for error monitoring. These are always on because Zealty does not work without them.
• Functional: Google Sign In, if you choose to sign in with Google.
• Analytics: Google Analytics (exported to our own Google BigQuery project) and Microsoft Clarity, which records session replays and heatmaps of how our pages are used, with form entries masked.
• Advertising: Google Ads tags and the Meta Pixel, which measure our ads and let us show you Zealty ads elsewhere.

These load when you use Zealty. By using our website, you accept this policy and the tracking described here. They collect your activity on our site, device details and identifiers, and Google, Meta and Microsoft may use this data for their own advertising and services.

If you do not want this, you can opt out at any time. Email [email protected] and we will stop linking your identity to advertising and analytics data within 10 business days, and usually sooner. That does not switch the tags off in your browser: to block them, use your browser settings or the ad-platform controls below. Essential cookies and security tools stay on. You can manage ads at youradchoices.ca, Google My Ad Center and Meta ad preferences. See the Microsoft Privacy Statement and Meta Privacy Policy.

6. Where your data is stored

We and our service providers store and process data in Canada and the United States, where it may be accessed by courts and authorities under local law. Alberta residents can ask us for more information about our service providers outside Canada at [email protected].

7. How long we keep it

We keep your information only as long as needed for the purposes above or as the law requires, then delete or anonymize it. Accounts are deleted within 90 days after you close them. Inquiry and referral records are kept up to 7 years for real estate record keeping. Call recordings are kept up to 13 months.

8. Security

We use reasonable safeguards, including encryption and access controls. If a breach creates a real risk of significant harm, we will notify you and the Privacy Commissioner as required.

9. Your choices and rights

You can ask to access, correct or delete your information, withdraw consent, or opt out of marketing or ad matching by emailing [email protected] or using the unsubscribe link. We respond within 30 days. You can also complain to the Office of the Privacy Commissioner of Canada or the Office of the Information and Privacy Commissioner for BC.

10. Children

Zealty is for adults 19 or older. We do not knowingly collect information from anyone younger.

11. AI assistant integration

If you connect Zealty to an AI assistant through our MCP server and sign in, we receive your name and email to verify your account. We do not see your conversations with the assistant.

12. Changes

We may update this policy and will post the new version with a new date. We will notify you of material changes.
